The Department of Consumer Affairs, (916) 322-7737. (CCR 7740)

What funding vehicles are permitted by statue?
Trust and insurance. (CCR 7735)

If trusting is permitted, what percent must be trusted?
100 percent. (CCR 7735)

Under what circumstances should trusts be set-up as irrevocable?
Only if trustor is receiving or has applied for public assistance. (CCR 7737)

Are pre-need sellers licensed by the state?
No. However, there is a license requirement to sell all insurance products.

Does statute require the seller of pre-need funeral arrangements to be a licensed funeral director or embalmer?
No.

Does California have a default (guarantee) fund if the seller of the pre-need mishandles the monies paid?
No.
