Consumer Issues

All consumer complaints against CFDA members should be made in writing and forwarded to Lydia Stewart (Membership Committee Chair).  Complaints can also be sent to the DCA.

Who has the right to decide what the funeral arrangements will be for an individual? (Who has the right to control disposition of remains?)
If an individual has set out his or her wishes in writing with a legal contract (including power of attorney for healthcare) or a preneed arrangement, that determines the right of disposition. If not, the order to control is: 1. Spouse, 2. Child who is 18 + years old or the majority of children over 18, 3. Parents, 4. Other more distant relatives. (H&S 7100)

What is the law regarding funeral processions and patrol fees?
Each county will have different ordinances about processions. A funeral director cannot charge a procession patrol fee if guests do not accompany a hearse.

Does the state offer a low-income assistance program for funeral services?
No. Contact your local community charities.
